Welcome to Gagago! 

We’re thrilled to have you here. Gagago is a platform designed to help you connect with others who share similar interests, including traveling to the same destinations. To start enjoying our services, simply create an account. We also offer exciting group trips for you to join! 

This Agreement serves as a contract between you and Gagago. By creating an account, you agree to the terms and conditions outlined here. 

As we strive to make your experience even better, we may occasionally update our platform or this Agreement. If there are any significant changes, we’ll notify you, and you’ll need to accept the updates to continue using the service. 

We’re excited to have you on this journey with us!

1. Eligibility

To create an account or use Gagago, you must: 

– Be at least 18 years old and legally able to form a contract with us. 

– Be authorized to use our service according to the laws of the United States and your local jurisdiction. 

– Have a clean legal record, including no felony convictions or offenses related to violence or sex crimes. 

By signing up, you confirm that the information you provide is true, accurate, and belongs to you. 

We want to create a respectful and inclusive space, so content that offends or discriminates against others based on race, color, nationality, age, religion, gender, identity, sexual orientation, disability, or socioeconomic status is not allowed. 

You agree to follow all local laws, rules, and regulations, and you are responsible for ensuring you are authorized to participate in any activities, including obtaining any necessary licenses. If you’re unsure, it’s always a good idea to seek legal advice. 

Please note that Gagago is not a dating platform, and we do not tolerate any form of inappropriate behavior or illegal solicitations. If three users report inappropriate behavior, your account will be suspended for 30 days, and repeated violations may result in a permanent ban. 

We always appreciate your feedback and aim to offer the best experience. However, if you’re no longer satisfied with the service or no longer agree to the terms, we ask that you remove your profile. If you fail to do so and attempt to damage or disrupt the platform, we will have to terminate your account.

2. Your Data, Content, and Information

When you create an account or use our service, you agree that most of the information you share, except for your account details, may be shared with other users, potential users, partners, and advertisers. 

By using the platform, you give Gagago the right to use your content in various ways—such as hosting, modifying, sharing, and using it for promotional and commercial purposes—without any limitations. This includes content you upload even after you’ve left the platform. Any personal information, including banking or financial details, should never be shared on your profile. 

It’s important to keep your password and account information secure, and you do so at your own risk if you share any personal details with others. Gagago, along with its team, won’t be responsible for any issues that arise from shared information. 

Your profile content will be monitored to ensure the community stays safe and friendly. We may suspend or delete accounts that don’t meet our guidelines. You can delete your account at any time through your profile settings. 

You are responsible for ensuring that the content you post does not violate any intellectual property or privacy rights of others. If you believe that someone has infringed on your work, please reach out to us at helpdesk@gagagoapp.com with the necessary details for us to investigate and take appropriate action.

3. Safety

At Gagago, our goal is to connect people and foster positive interactions. However, please remember that we cannot control the actions of other users, and we are not responsible for any loss, harm, or negative experiences that may arise from using the platform. You acknowledge that some activities or interactions through the app may carry risks, and you assume responsibility for any consequences that may come from your use of the platform.

We encourage you to be cautious when sharing personal information, just as you would in any other situation. Always trust your instincts and do your own research when interacting with others, whether online or in person.

If you choose to meet up with other members in person or travel together, please do so at your own discretion and risk. Gagago does not conduct background checks on users, so it’s important that you take steps to protect yourself. We recommend meeting in public places, informing family or friends about your plans, and waiting to share transportation or accommodation until you feel completely comfortable.

You also understand that Gagago does not verify criminal backgrounds or make any guarantees about the conduct or suitability of other members. To the fullest extent permitted by law, you agree to release Gagago, its owners, employees, and associates from any claims or damages arising from your interactions with others, including injuries or harm of any kind. Your safety is our priority, and it’s important that you take necessary precautions.

4. LGBTQ+ Community

At Gagago, we respect and celebrate diversity, including sexual orientation. When creating your account, you’ll be asked to provide your sexual orientation, which is visible to other members unless you select “Prefer not to say.”

We encourage you to be mindful of your local laws and regulations regarding sexual orientation. If you’re in a location where LGBTQ+ rights are restricted or where same-sex relationships may be criminalized, we recommend keeping your sexual orientation private on your profile for your safety.

5. Third Parties

Gagago will display advertisements, promotions and deals offered by third parties. If you decide to contract with these third parties made available to you through our service, your relationship with them will be solely and directly governed by them. Gagago is not responsible or liable for the availability, suitability, quality or your satisfaction with the products and services offered by such parties.

6. Other User Content

When using Gagago, you may come across content shared by other users that could be incorrect, misleading, inappropriate, or offensive. While we don’t review all user-generated content, we want to ensure you have a positive experience. You’re in control of your interactions and can use our double opt-in feature to manage who can contact you.

If you encounter content or behavior that feels inappropriate or abusive, you can easily block or report users through the “Block & Report” feature on their profile. We take these matters seriously and have zero tolerance for harmful or offensive content. Your safety and comfort are our priority, and we encourage you to reach out if you need support.

7. Indemnification and Limitation of Liability

To the fullest extent allowed by law, you agree to indemnify, defend, and hold harmless Gagago, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses, including attorney’s fees, that arise out of or are related to your use of the service, participation in Gagago trips, or breach of this Agreement.

Our liability will be limited to the amount you paid for our services in the 12 months prior to the event giving rise to the claim, or $100, whichever is greater.

8. Gagago Trips

Gagago offers exclusive small-group trips designed for travelers seeking unique and curated experiences. These trips are intended for specific groups based on criteria such as gender and age to ensure compatibility and a positive experience for all participants.

Eligibility & Compatibility: Gagago trips are designed for small groups with specific participant criteria (e.g., gender, age). We reserve the right to approve bookings based on group compatibility to ensure a positive experience for all.

Host Acceptance: Gagago reserves the right to approve or deny participation in a trip based on the host’s discretion. The host will assess compatibility with the group and ensure that the participant aligns with the trip’s atmosphere and requirements. Gagago may, at the host’s request, decline a booking if it is determined that the participant is not a good fit for the group dynamic.

Health & Fitness: Participants must be physically fit and capable of joining trip activities. You must disclose any relevant health conditions, and Gagago reserves the right to refuse participation based on health concerns.

Booking & Payment: Full payment or deposit is required at booking, and reservations are confirmed once payment is processed. Gagago reserves the right to cancel bookings if payment is not received on time.

Trip Modifications: Gagago may modify or cancel trips due to unforeseen circumstances. In such cases, you’ll be offered a full refund or alternative options.

9. Governing Law

This Agreement is a binding legal contract between you and Gagago. Any claims or disputes arising from your use of our services will be governed by the laws of the State of Texas, United States.

Users located in the European Union may have additional or different rights, as provided by applicable law.

You agree to waive any objections to disputes being handled in Texas and to waive your right to a jury trial. You also agree not to participate in any class or collective action against Gagago, whether in court or through arbitration.

Gagago is not obligated to intervene in disputes between you and other users or third parties, though we may assist in facilitating a resolution.

If any part of this Agreement is found to be invalid by a court of competent jurisdiction, the rest of the Agreement will remain valid and enforceable. This Agreement continues to apply even if you stop using the service or delete your account.
